Terms of Service

1. Eligibility and acceptance

By using ZodiaPet, you agree to these Terms and our Privacy Policy. You must be at least 13 years old. If you are not old enough to enter a binding agreement where you live, a parent or legal guardian must review and accept these Terms for you. ZodiaPet is not intended for children under 13.

2. The service

ZodiaPet is an evolving fantasy companion and AI image and video experience. Features may include companion creation, local or account-based saving, image and video generation, previews, downloads, and sharing. During the MVP period, features may change, pause, fail, or be subject to generation limits without notice.

3. Your uploads and permissions

You keep your rights in photos and other material you submit. You give ZodiaPet and its service providers a limited permission to host, copy, process, transform, and transmit that material only as reasonably needed to operate, secure, and improve the requested service.

You must own your uploads or have permission from every identifiable person shown. Do not upload a photo of anyone under 13, private or intimate material, confidential documents, or content that violates another person's privacy, publicity, intellectual property, or other rights.

4. AI-generated content

AI output may be inaccurate, unexpected, similar to content generated for others, or inconsistent with your request. We do not guarantee that an output is unique, error-free, suitable for a particular purpose, or eligible for intellectual-property protection. Review every image before downloading or sharing it.

5. Acceptable use

• Do not use ZodiaPet for unlawful, deceptive, abusive, harassing, exploitative, or harmful activity.
• Do not upload, request, create, or share pornography, nudity intended to be sexual, sexually explicit material, fetish content, or any other NSFW content.
• Do not create or attempt to create sexual content involving minors, or content that sexualizes, exploits, grooms, or endangers a minor. Such use is strictly prohibited.
• Do not upload content without the necessary rights or consent.
• Do not attempt to bypass generation limits, access another person's private Memory, probe security, disrupt the service, or reverse engineer protected systems.
• Do not use generated content to impersonate, defame, deceive, or harm a real person.
• Do not bypass, disable, probe, or evade our content moderation and safety controls. We may block requests and suspend access when content is flagged or prohibited.

6. ZodiaPet content

The ZodiaPet name, interface, companion designs, Aria character, graphics, software, and other service materials are owned by ZodiaPet or its licensors. These Terms give you a personal, limited, revocable, non-exclusive right to use the service; they do not transfer ownership of ZodiaPet intellectual property.

7. Free and paid features

Creating a companion is free. Current one-time AI Memory options include a $2.99 high-resolution image download and a $4.99 five-second video with HD MP4 download. Customers who share their Memory through the offered social sharing flow may receive a $2 video discount and pay $2.99. Prices and included benefits are shown before purchase and may change prospectively. These purchases do not create a subscription. Additional payment and refund terms may be presented at checkout.

8. Availability and termination

We may modify, limit, suspend, or discontinue any part of ZodiaPet, and may restrict access when reasonably necessary to protect the service, users, providers, or legal rights. You may stop using the service at any time. Sections that by their nature should survive termination will remain in effect.

9. Disclaimers

To the fullest extent permitted by law, ZodiaPet is provided on an as-is and as-available basis without warranties of uninterrupted operation, accuracy, merchantability, fitness for a particular purpose, or non-infringement. Nothing in ZodiaPet is professional, medical, financial, or legal advice.

10. Limitation of liability

To the fullest extent permitted by law, ZodiaPet and its operators will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or access arising from use of the service. Rights that cannot legally be limited remain unaffected.

11. Changes and contact

We may update these Terms as the service evolves. Continued use after revised Terms take effect means you accept them. Material changes will be communicated when reasonably practical. Questions about these Terms may be sent to joydehuang@gmail.com.
